USCIS operates two major programs to ensure immigration compliance and prevent fraud:
- Administrative Site Visit and Verification Program (ASVVP)
- Targeted Site Visit and Verification Program (TSVVP)
Both are managed by the Fraud Detection and National Security Directorate (FDNS), empowering officers to conduct thorough compliance reviews.
What is a compliance review?
FDNS immigration officers perform compliance reviews to verify that both petitioners and beneficiaries are adhering to the terms of their immigration petitions. Reviews may include:
- Examination of petitions and supporting documents
- Research in public records and government systems
- Interviews with petitioners, beneficiaries, or third parties
(often through unannounced site visits, which may be in-person, by phone, or electronic)
Focus on H-1B petitions
While site visits can apply to various petition types, H-1B Specialty Occupation Worker petitions are a primary focus. Site visits may be:
- Randomly selected
- Data-driven (targeted)
During these visits, officers will:
- Confirm the existence of the petitioning organization
- Verify the H-1B beneficiary’s actual work location, duties, hours, and salary
Cooperation is critical
Refusal to comply with a FDNS site visit, telephone interview or electronic inquiry in the compliance review process could lead to adverse adjudicative actions. In certain cases, refusal to cooperate or participate may result in denial of a petition or revocation of a petition approval, if a petitioner, beneficiary, or, in certain circumstances, end client (work site) refuses to cooperate with FDNS.
